HERA FERTILITY TERMS OF SERVICE AND USE

1. ACCEPTANCE OF TERMS
By using Hera Fertility’s services, including purchasing an at-home sperm test, accessing telehealth services, uploading third-party test results, or interacting with our website and platform, you agree to these Terms of Service and Use. If you do not agree, do not use our services.

2. ABOUT HERA FERTILITY
Hera Fertility partners with third-party CLIA-certified laboratories for all semen analysis tests. While we facilitate the ordering and result delivery process, we do not conduct lab testing ourselves. Test results are provided by our partner laboratory, and any medical decisions should be made in consultation with a licensed healthcare provider.

3. SERVICES OFFERED
Hera Fertility provides:
(a) At-Home Sperm Test Kits - A mail-in semen analysis processed by a certified lab.
(b) Telehealth & Consultations - Virtual health coaching and provider consultations based on test results.
(c) Test Result Upload Service - Users can upload semen analysis results from other labs to receive insights and recommendations.
(d) Platform & Website Access - Users may browse, interact, and engage with Hera Fertility’s content and digital services.

4. MEDICAL DISCLAIMER
Hera Fertility does not provide medical diagnoses. Our services are for informational and wellness purposes only and do not replace professional medical advice. Always consult a physician before making health decisions based on test results.

5. ORDERING, SHIPPING, AND RETURNS

  • Orders are shipped within the U.S. only (excluding New York, Hawaii, and Alaska).
  • Testing requires abstinence from ejaculation for 48 hours (no more than 5 days) before sample collection.
  • Samples must be shipped Monday-Thursday morning to ensure lab processing.
  • If a sample is unusable due to user error (e.g., failure to follow instructions), a new test must be purchased.
  • Refunds are only available before test kits are shipped. Once shipped, no refunds are granted.

6. TEST RESULT UPLOAD SERVICE
Users may upload sperm test results from external labs to Hera Fertility for review and insights. By doing so, you:

  • Confirm that the results belong to you.
  • Understand that Hera Fertility does not verify the accuracy of third-party test results.
  • Grant Hera Fertility permission to store and analyze the data.

7. ACCEPTABLE USE POLICY
Users agree not to:

  • Use the platform for illegal, fraudulent, or unauthorized purposes.
  • Submit false or misleading information, including fraudulent test results.
  • Copy, scrape, or distribute any content from the Hera Fertility platform without permission.
  • Upload or transmit viruses, malware, or other harmful content.
  • Violate any applicable laws while using our services.

Hera Fertility reserves the right to suspend or terminate accounts violating this policy.

8. DATA STORAGE & PRIVACY
(a) Data Security: All data, including test results, is stored securely in compliance with applicable privacy laws.
(b) User Ownership: Users retain ownership of their test results and can request deletion of their data.
(c) De-identified Data: Hera Fertility may use aggregated, de-identified data for research and service improvement.
(d) HIPAA Compliance: Hera Fertility operates in compliance with relevant data protection regulations but is not a covered entity under HIPAA.

9. DISCLAIMERS & LIMITATION OF LIABILITY

  • We do not guarantee that test results are error-free or that they will predict fertility outcomes.
  • Hera Fertility is not responsible for delays or errors caused by third-party labs or shipping carriers.
  • Users assume full responsibility for decisions made based on test results.
  • Hera Fertility is not responsible for third-party services or external links provided on the platform.

10. DISPUTE RESOLUTION & ARBITRATION

  • Any disputes arising from the use of Hera Fertility services shall be resolved through binding arbitration in [Jurisdiction].
  • Users waive the right to participate in class-action lawsuits.

11. CHANGES TO TERMS
Hera Fertility reserves the right to update these Terms at any time. Continued use of services after changes are posted constitutes acceptance of the new terms.
